Under the DMCA, a counter-notice must include the following information:

  • Your physical or electronic signature.
  • An identification of the material that was removed and the location at which the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification of the material (whether or not it was intentional).
  • Your contact information, including at a minimum your mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which the address you provided is located (or, if you live outside the United States, the U.S. District Court for the Northern District of California) and that you will accept service of process from the person who provided the DMCA Notice or an agent of such person.
